Terms and Conditions

1. Who can use the Services

You must be at least 13 years old to use the free Services, and old enough to form a binding contract where you live (usually 18) to buy an upgrade. If you use the Services on behalf of a business or another person, you confirm that you have the authority to accept these Terms for them, and “you” includes them.

2. The free site generator

When you enter an Instagram or TikTok handle, we read the information that profile shows publicly: for example its name, bio, profile photo, follower count, and the images and videos on it. We then design and publish a one-page website from it, with an About page and a contact form. We never ask for, and you must never give us, your social media password.

• Only profiles you control. Only generate a site from a profile that belongs to you, or one you are authorised to represent. If you generate a site from a profile that is not yours, the owner of that profile may claim it, and we may remove it.
• Copies of your media. Links to images and videos on Instagram and TikTok expire, so we copy the media we use into our own storage and serve it from there, next to your site.
• Unclaimed sites. A site that has not been claimed through an account can be viewed at its link, but it is hidden from search engines and left out of our directory. We may remove unclaimed sites at any time.
• Limits. To keep the Service fair and affordable, we limit how many sites can be generated from one IP address or account in a period of time. We may change these limits.
• No guarantee of results. Instagram and TikTok change how profiles are shown without notice. Sometimes a profile cannot be read, or can only be read in part. We do not guarantee that a site can be generated for any particular profile, or what it will look like.
• The free Service may change. We may change, limit or stop the free Service, or any feature of it, at any time.

3. Accounts and claiming a site

If you give us your email address on the Create My Site form and have no account, we create one for you and email you a link to set your password. You can also register directly. Claiming a site ties it to your account, moves it to an address such as pretty.cool/yourhandle, lists it in our Creators directory and sitemap, and lets you manage it and your upgrades from My Account.

Keep your account details accurate and your password private. You are responsible for everything that happens under your account. Tell us straight away if you think someone else has accessed it.

Short addresses are handed out first come, first served. We may take back or change an address if it impersonates someone, infringes a trademark, is offensive, or is needed to settle a dispute over who owns a handle.

4. Your content

“Your Content” means the material that comes from your profile (photos, videos, bio and name), anything you type into our forms, messages you send in the design chat, and anything you add to a WordPress site we host for you.

You own Your Content. You give us a worldwide, non-exclusive, royalty-free licence to copy, store, host, resize, reformat, adapt and publicly display Your Content, and to send it to our service providers (including the AI providers described in section 5). We use this licence only to build, run, host, improve and promote the Services. Promotion includes showing your claimed site in our Creators directory and sitemap. The licence ends when your site and Your Content are deleted, except for copies kept for a limited time in backups, or where the law requires us to keep them.

You promise that you own Your Content or have every permission needed to grant this licence, and that publishing it does not infringe anyone’s copyright, trademark, privacy or publicity rights, or break any law. If Your Content includes other people, you are responsible for having their permission.

Our material. The Services, our software, our site templates and design system, and the GetPrettyCool name and logo belong to us or our licensors. The design generated for your site is licensed to you to use as your website for as long as you use the Services. A small “Made with GetPrettyCool” credit appears on sites we host. Please do not remove it from a free site.

5. AI-generated designs and copy

Your site’s design, layout and text are produced by artificial intelligence models run by third-party AI providers, using Your Content and anything you tell us you want. The same applies to changes made with Custom design changes. AI output can be inaccurate, incomplete or unexpected. It may, for example, describe you or your business wrongly, or pick colours or wording you would not have chosen.

Review your site before you rely on it or share it. Once you have claimed a site, you are responsible for what it says. If something is wrong, you can regenerate the site, change it with the design upgrade, or ask us to take it down.

6. Instagram, TikTok and other third parties

GetPrettyCool is not affiliated with, endorsed by or sponsored by Instagram, Meta, TikTok or ByteDance. Those names are used only to describe where your content comes from. Your use of those platforms is governed by their own terms.

The Services rely on other providers, including cloud hosting, payment processing by Stripe, AI model providers, and domain and certificate services. Where you deal with one of them directly, such as your own Stripe account or your domain registrar, their terms apply to that relationship. We are not responsible for their services.

7. Acceptable use and prohibited content

GetPrettyCool sites must be suitable for a general audience. The rules in this section apply to everything that appears on, or is linked from, a site we generate or host. That includes Your Content, the profile a site is generated from, anything you ask our AI to add, products listed through Stripe Catalog, and anything you add to a Stand alone WordPress site. Content being allowed on Instagram, TikTok or another platform does not mean it is allowed here.

Prohibited content

You must not publish, upload, sell, link to, or ask us to generate:

• Sexually explicit or X-rated material. This includes pornography, depictions of sexual acts, nudity shown in a sexual context, and sexually suggestive content whose main purpose is arousal.
• Adult services and products. This includes escort or companionship services, paid sexual services, webcam shows, sexually explicit subscription content, and links or calls to action that promote any of them.
• Any sexual content involving minors. We have zero tolerance for content that sexualises, exploits or endangers anyone under 18. We remove it immediately, close the account, and report it to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement.
• Non-consensual intimate imagery. This includes intimate or sexual images of a real person shared without their consent, and AI-generated or altered (“deepfake”) images of that kind.
• Graphic violence and self-harm. This includes gore, content that glorifies or incites violence or terrorism, and content that promotes suicide, self-harm or eating disorders.
• Hate and harassment. This includes content that attacks or demeans people because of race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation or age, and content that bullies, threatens or harasses anyone.
• Illegal or dangerous goods and services. This includes illegal drugs, weapons, ammunition and explosives, counterfeit goods, unlicensed gambling, and anything Stripe’s rules prohibit.
• Other unlawful or infringing content. This includes defamatory content and anything that infringes someone else’s copyright, trademark, privacy or publicity rights.

Prohibited conduct

You must also not use the Services, or a site we host, to:

• impersonate a person, creator or business, or suggest a connection with them that does not exist;
• run scams, phishing or malware, or collect other people’s personal information without a lawful basis;
• send spam, including through contact forms;
• scrape, overload, probe or attack the Services, get round rate limits, content filters or security measures, or generate sites in bulk or by automated means;
• resell or white-label the Services without our written permission.

How we enforce these rules

We may use automated tools and manual review to check profiles, media, generated sites and products. If we reasonably believe that something breaks this section, we may, at any time and without notice: refuse to generate a site; leave out or remove any photo, video or text; hide a site from the Creators directory; take down a site, shop or product; or suspend or close an account. We decide, acting reasonably, whether content breaks these rules. If a site is removed for breaking this section, its upgrades end without a refund (see section 10).

If you think a site we host breaks these rules or infringes your rights, contact us with the address of the site and a description of the problem.

8. Contact forms on your site

Every site includes a contact form. Messages that visitors send through it pass through our systems and are forwarded to the email address on your account. For a site that has not been claimed, they may be forwarded to us instead. We may filter, rate-limit or block messages to prevent abuse. We do not guarantee that every message will be delivered. How you use and reply to messages you receive is your responsibility.

9. The Creators directory and creator numbers

Claimed sites may be listed on our Creators page and in our sitemap. Each generated site may also get a sequential creator number, and early sites may be given a status such as “Charter Creator” or “Founding Creator”. Creator numbers and statuses are for recognition only. They have no monetary value, cannot be sold or transferred, and give no right to any discount, payment, ownership or other benefit unless we have separately promised one in writing. We may change, reassign or end the directory, the numbering or the statuses.

10. Paid upgrades: general terms

• Price. The price, currency and billing period shown at checkout are the ones that apply. Prices on other pages are for information only. Taxes are added where required.
• Payment. Payments are processed by Stripe through our checkout. We do not store your full card details.
• Subscriptions. Custom domain name, Stripe Catalog and Stand alone WordPress site are yearly subscriptions. They renew automatically at the end of each year, and your saved payment method is charged the renewal price, until you cancel. We will tell you in advance before we change a renewal price.
• Cancelling. You can cancel a subscription at any time from My Account. Cancelling stops future renewals. You keep the upgrade until the end of the year you have already paid for, and it ends then. You will not be charged again.
• Failed payments. If a renewal payment fails, we may retry it, and we may suspend or end the upgrade if it is not paid.
• Refunds. Unless the law where you live requires otherwise, payments are non-refundable once the upgrade has been delivered or set up, and we do not refund the unused part of a subscription year. If something did not work as described, contact us. We will look at every request fairly.
• Upgrades depend on your site. Upgrades attach to a site in your account. If that site is removed for breaking these Terms, its upgrades end with it, without a refund.

11. Terms for each upgrade

Custom domain name (yearly subscription)

• You must own or control the domain you connect. Buying the domain and renewing it with your registrar are your responsibility, and those fees are not part of this subscription unless we have agreed otherwise in writing.
• We give you the DNS records to add and check them until they are correct. Once the domain verifies, we issue a security certificate and serve your site on it. How long DNS changes take to spread depends on your registrar and on the internet, not on us.
• If the subscription ends, or your DNS records stop pointing at us, your site goes back to its pretty.cool address. We are not responsible for email or any other service on your domain.

Custom design changes (one-time purchase)

• Each purchase comes with an allowance of AI design work for your site. It is shown as a meter in My Account and used up as changes are made. The allowance is not money and cannot be exchanged for cash. Allowance that has been used is not refundable. You can buy more at any time.
• Changes are made by AI from your instructions, and apply to your live page. Section 5 applies to them. Undo lets you go back to an earlier version.
• Our support team can read your design conversation and your site, and may make changes on your behalf when you ask for help or when it is needed to fix a problem.
• We may refuse or limit a change that would break the site, break these Terms, or use an unreasonable amount of the allowance in one request.

Stripe Catalog (yearly subscription)

• Stripe Catalog adds a shop section to your pages, showing products from your own Stripe account. You connect that account through Stripe. Stripe’s terms, including the Stripe Connected Account Agreement, apply between you and Stripe.
• You are the seller. Buyers pay you through Stripe, and the money goes to your Stripe balance. You alone are responsible for your products and prices, for delivering what you sell, and for customer service, refunds, chargebacks, taxes, product descriptions and following the law. We are not a party to your sales, and we never hold your customers’ money.
• We may hide a shop or product that breaks these Terms or Stripe’s rules. If the subscription ends, or you disconnect Stripe, the shop section comes off your pages. Your Stripe account and products stay yours.

Stand alone WordPress site (yearly subscription)

• We move the design made for you into a WordPress site that you can log in to and edit. Hosting, core updates and backups are included while the subscription is active.
• You are responsible for what you add, including content, users, and any themes or plugins you install. We may disable a theme or plugin that is insecure, breaks the site, or harms our servers or other customers. Backups are a safety net for us, not a guaranteed archive for you. Keep your own copies of anything important.
• Before the subscription ends, you can ask us for an export of your site’s content. After it ends, the site may be taken offline and deleted.

12. Suspension, removal and deleting your site

You can delete your sites, or close your account, at any time. Contact us if you need help. Deleting a site removes it from our hosting. Copies may stay in backups and caches for a limited time.

We may suspend or remove a site, an upgrade or an account, with or without notice, if we reasonably believe it breaks these Terms or the law, puts other people or the Services at risk, or if we receive a valid complaint about it. Where it is reasonable to do so, we will tell you why and give you a chance to fix the problem first.

Sections 4 (the licence for backups and legal holds), 5, 6 and 13 to 18 continue to apply after your use of the Services ends.

13. Privacy

Our Privacy Policy explains what personal information we collect and how we use it. This includes your email address, the IP addresses we record when a site is generated and when you accept these Terms, analytics about how our pages are used, and the messages that go through contact forms. By using the Services you agree that we may handle your information as it describes.

14. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT AI OUTPUT WILL BE ACCURATE, OR THAT YOUR SITE WILL RECEIVE ANY PARTICULAR TRAFFIC, SEARCH RANKING OR SALES.

Some jurisdictions do not allow some of these exclusions, so some of them may not apply to you. Nothing in these Terms limits rights you have under consumer law that cannot be waived.

15. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) US $50.

16. Indemnity

You agree to defend and indemnify us, and hold us and our officers, employees and contractors harmless, against claims, losses and reasonable costs (including legal fees) arising from Your Content, your site, your sales through Stripe Catalog, your breach of these Terms, or your breach of anyone else’s rights.

17. Changes to these Terms

We may update these Terms. When we do, we will change the version number and the “last updated” date at the top of this page. If a change is significant, we will tell you by email or on the site before it takes effect. The version in force when you generate a site is the one recorded against it, and you will be asked to accept the current version each time you create a new site. If you keep using the Services after a change takes effect, you accept the updated Terms. If you do not agree to a change, stop using the Services and cancel any subscriptions.

18. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law rules. Any dispute that cannot be settled informally will be heard in the state or federal courts located in California, and you and we both consent to their jurisdiction. This does not take away any right you have to bring a claim in the courts where you live, if the law gives you that right.

If any part of these Terms cannot be enforced, the rest remains in effect. If we do not enforce a right, we have not given it up. You may not transfer these Terms to someone else without our consent. We may transfer them as part of a merger, acquisition or sale of the business. These Terms, together with our Privacy Policy and anything shown at checkout, are the whole agreement between you and us about the Services.
